Is Your Contractor Actually
a Contractor?

The ATO and Fair Work Ombudsman Are Cracking Down.
Find Out Where You Stand Before They Do.

Authorities Are Cracking Down on Sham Contracting

You signed a contractor agreement. They invoice you monthly. You assumed everything was sorted.

But the ATO does not care what your contract says. They look at what actually happens.

In March 2026, the ATO and Fair Work Ombudsman issued a joint statement confirming they are ramping up enforcement on sham contracting across multiple industries. Investigations are already underway.

If your contractors work set hours, use your equipment, follow your processes and cannot subcontract the work, the ATO may classify them as employees. And the consequences are serious.

The Penalties Are Real

Plus back pay for the entire engagement period, unpaid superannuation with interest, PAYG withholding penalties, payroll tax liabilities and potential workers compensation exposure.

Each pay period the sham arrangement continues can be a separate contravention. A 12-month arrangement with fortnightly pay could generate 26 separate contraventions.

Free Sham Contracting Risk Check

Find Out in 5 Minutes If Your Contractor Arrangements Are at Risk

Our free questionnaire-based risk check assesses your contractor arrangements against the ATO multi-factor test and flags any red zones.
It is not a full legal audit. But it gives you a clear picture of where you stand and whether you need to take action.

If Your Risk Check Flags Issues, We Can Sort It

At Law by Design, we have built a fixed-price contractor compliance service specifically for this.

Full Contractor Compliance Audit

We review every contractor arrangement in your business against the ATO multi-factor test, the Fair Work Act requirements and relevant case law. You get a clear report showing which arrangements are compliant, which are at risk and what needs to change.

Agreement Review & Restructuring

We review and redraft your contractor agreements to ensure they are compliant, enforceable and properly protect your business. If arrangements need to be restructured as employment, we guide you through the transition.

Ongoing Compliance Support

As you engage new contractors, we provide ongoing support to make sure every new arrangement is set up correctly from day one. No more guessing. No more risk.
